CONFOTUR Law: How the Dominican Republic’s Tourism Incentive Works

The CONFOTUR Law, formally established as Law No. 158-01, was created to accelerate tourism development in the Dominican Republic and encourage investment in regions with tourism potential. Since its adoption in 2001, the legislation has been modified several times and has become an important part of the country’s framework for attracting tourism projects and related investment.

CONFOTUR is the acronym commonly used for the Consejo de Fomento Turístico, the government body responsible for applying the law. Its role is particularly relevant to developers and investors because a project must receive the appropriate classification before it can access the incentives provided under the legislation.

What Is the CONFOTUR Law?

Law No. 158-01 was approved on October 9, 2001, with the objective of promoting tourism development in areas considered to have limited development or significant tourism potential. The framework was subsequently amended by Laws Nos. 184-02, 318-04, 253-12 and 195-13.

The legislation is designed to encourage investment in tourism-related activities and expand development beyond the country’s most established destinations. Its scope covers qualifying tourism projects and certain complementary activities, meaning the incentives are not limited exclusively to traditional hotels.

The framework can apply to projects involving accommodation, tourism infrastructure and other activities recognized under the law. Depending on the project and its classification, eligible investments can receive fiscal and customs benefits intended to reduce the cost of development and operation.

What Does CONFOTUR Do?

CONFOTUR is responsible for implementing the framework established by Law No. 158-01. The council evaluates qualifying projects and determines whether they can be classified to receive the incentives established by the legislation.

The process is supported by the Technical Directorate of CONFOTUR, created through Decree No. 372-14. This unit handles the technical matters associated with the application of the law, including the technical and legal evaluation of applications and recommendations concerning the benefits applicable to individual projects.

A project may receive a provisional or definitive classification. In practical terms, classification means that CONFOTUR has approved the project as eligible to benefit from the incentives established by Law No. 158-01 and its amendments. The official CONFOTUR portal provides information about the classification process and the documentation required for applications.

What Tax Benefits Does CONFOTUR Provide?

The incentives are one of the main reasons CONFOTUR has become significant for tourism developers and investors. The benefits established under the law include exemptions affecting several categories of taxes and duties, subject to the applicable requirements and the specific classification of the project.

Among the benefits recognized by the Dominican tax authorities are exemptions involving income tax on the activities covered by the incentives, taxes associated with the incorporation of companies and capital increases, and certain real estate transfer taxes.

Qualified projects may also receive exemptions from the Impuesto al Patrimonio Inmobiliario (IPI), as well as import duties and ITBIS on qualifying machinery, equipment, materials and movable goods required for construction, initial equipment and the start of tourism operations.

The law also provides mechanisms concerning financing and other investment-related tax treatment. Because the exact benefits depend on the legal framework and the characteristics of each approved project, investors should not assume that every CONFOTUR development receives an identical package of exemptions.

How Long Do the Incentives Last?

The current framework provides for a 15-year fiscal exemption period for qualifying tourism companies, beginning from the completion of construction and equipment of the approved project. The legislation also establishes a period within which an approved project must begin operating on a sustained and uninterrupted basis.

This distinction is important for investors. CONFOTUR approval does not mean that an exemption automatically applies indefinitely. Projects must comply with the conditions established by the law and its implementing regulations, and failure to meet applicable requirements can result in the loss of benefits.

How Does a Project Qualify for CONFOTUR?

Developers seeking classification must submit their project through the official CONFOTUR process. The Technical Directorate reviews the application and evaluates the project from both technical and legal perspectives before making its recommendations to the council.

The process is governed not only by Law No. 158-01 and its amendments but also by Decree No. 372-14, which serves as the regulation for applying the legislation, and by Resolution No. 109-15, which approved the guide for presenting tourism projects seeking access to the incentives.

Developers can consult the official CONFOTUR portal for information about classification, requirements and available services. The government portal also provides a mechanism for checking classifications granted to tourism projects.

What Does CONFOTUR Mean for Property Buyers?

CONFOTUR is also relevant to people purchasing property in qualifying tourism developments, particularly in markets such as Punta Cana, Bávaro, Cap Cana and other destinations where tourism-oriented real estate has expanded.

Some of the tax advantages associated with qualifying projects can benefit eligible purchasers, particularly in connection with real estate transfers and property taxation. However, the existence of a CONFOTUR classification should not be interpreted as a blanket exemption from every tax or fee associated with a property transaction.

For buyers, the key issue is therefore to verify the project’s actual classification and determine which benefits apply to the specific transaction. The terms of the project’s approval, the identity of the purchaser and the applicable tax rules can all affect the treatment of an individual acquisition.

CONFOTUR and Medical Tourism

The scope of the framework was also expanded to include certain tourism projects focused on healthcare services. Resolution No. 49-2014 opened the way for qualifying projects connected to medical tourism to benefit from the Law No. 158-01 framework.

This approach recognizes medical tourism as a potential source of international visitor flows distinct from conventional leisure tourism. It also allows the incentive framework to support tourism-related investments that combine healthcare services with international demand.

Why CONFOTUR Matters to Tourism Investment

For the Dominican Republic, CONFOTUR forms part of a broader strategy to attract capital into tourism and encourage the development of new projects. The incentives can reduce certain fiscal and import-related costs during the development and initial operation of qualifying investments.

The framework is particularly relevant to international investors because tourism development often requires substantial upfront capital for land, construction, equipment and infrastructure. By reducing certain taxes and duties, the legislation can alter the financial structure of an eligible project.

At the same time, CONFOTUR classification is not simply a tax designation. It is a regulatory approval that requires a project to pass the evaluation established under the Dominican Republic’s tourism development framework. Investors should therefore examine both the commercial characteristics of a project and the precise legal conditions attached to its classification.

What Investors Should Check Before Buying

Anyone considering a property or investment marketed as being under CONFOTUR should verify the project’s official classification rather than relying solely on promotional material. The classification status, type of approval and applicable incentives are important elements of the investment’s legal and financial picture.

It is also important to distinguish between benefits available to the project developer and those that may apply to subsequent purchasers. Tax treatment can depend on the transaction and on the requirements established by the Dominican tax authorities.

For that reason, investors and buyers should review the project’s documentation and obtain professional legal and tax advice before completing a transaction. CONFOTUR can provide substantial incentives, but those benefits operate within a specific legal framework and are subject to conditions.

A Long-Standing Pillar of Dominican Tourism Policy

More than two decades after Law No. 158-01 was introduced, CONFOTUR remains an important mechanism within the Dominican Republic’s tourism investment system. Its combination of tax incentives, customs benefits and project classification has helped establish a framework through which qualifying tourism developments can receive preferential treatment.

For developers, the principal consideration is whether a project meets the requirements for classification. For buyers and investors, the critical question is which benefits actually apply to the specific project and transaction. Understanding that distinction is essential when evaluating the financial and legal advantages associated with a CONFOTUR development.
